Davido challenges Amaju Pinnick’s ‘breach of contract’ case, case postponed until December 14
Afrobeats superstar, David Adeleke, popularly known as Davido, has filed a preliminary objection to contest the N2.3 billion breach of contract suit filed against him and his record label, Davido Music Worldwide Limited, by Brownhill Investments Company Limited and its chairman , Amaju Pinnick.
Pinnick filed a N2.3 billion suit before the Delta State High Court, Effurun, against Davido for an alleged breach of agreement/contract.
In the action, the former president of the Nigeria Football Federation NFF and his company asked the court to grant the amount as general compensation against Davido, following his refusal to honor the agreement and contract signed with him to play in the 19th edition of the “ Warri Again” on October 6, 2023, for which he failed to show up after raising the sum of US$94,500 (equivalent to N70 million). They stated that they also incurred additional expenses of US$18,000 to secure the chartered private jet to transport Davido (1st defendant) and his team, but he refused to attend the show.
ThisDay reported that upon the resumption of the hearing of the case, Davido, through his lawyer, filed a motion challenging the jurisdiction of the court to deal with the matter.
In his preliminary objection, the artist based his response on the grounds that the case is a debt collection issue and that the applicant should have written a letter of demand before rushing to court. He further stated that music executive Sosoberokon is not his agent and does not negotiate performance contracts on his behalf.
Although the singer claimed that he was not paid for the show and that Sossó is not his agent, he admitted to having received payment of US$94,500, but stated that the amount was payment only for promoting the show.
In the sister case bordering on criminal defamation, Davido, through his team of lawyers led by Norrison Quakers (SAN) Senior Advocates of Nigeria, also filed a preliminary objection challenging the jurisdiction of the court, alleging that the defamatory statements were published online but o the applicant has not demonstrated that the defamatory statements were downloaded and viewed in Delta State to give the court jurisdiction.
Both matters were postponed to December 14, 2023, for the court to rule on the preliminary objections presented in both cases.
Furthermore, in the N500 million defamation case filed against Israel, Davido’s Staff, no defense was filed on behalf of Israel and the court has already granted the request for an injunction prohibiting Israel from making any defamatory statements against Pinnick.
