Court refuses to reverse ruling that bars NBC from enforcing fines on broadcasters


A Federal High Court in Abuja on Thursday dismissed an application by the National Broadcasting Commission (NBC) seeking an order setting aside a judgment restraining it from imposing fines on broadcasters in the country.

In his ruling, Judge James Omotosho dismissed all of NBC’s arguments as “consequential.”

Judge Omotojo concluded that the commission had failed to defend itself, despite having been served with proceedings and a notice of hearing for the proceedings that led to the decision.

Contrary to NBC’s argument that the court proceedings that led to the judgment had not been served, the judge ruled that “the court documents show that the service was affecting the respondent (NBC), but the filing This shows that he failed to comply with the law and refused to appear in court.” ”

He said there was an affidavit of the facts testified by the court bailiff, confirming that the court proceedings were held multiple times before the commission.

“The respondent cannot argue that it was not served. The objection is hereby overruled.”
