BREAKING: Court sacks Enugu State Senator, declares Labour Party candidate winner


A House of Representatives tribunal has sacked Simon Atigwe, the Senator representing Igboeze North/Udenu Federal Constituency.

The court also declared Dennis Nnamdi Agbo of the Labour Party as the actual winner of the re-election for Igbo-Eze North/Udenu Federal Constituency.

The Independent National Electoral Commission (INEC) declared Atigwe of the Peoples Democratic Party (PDP) the winner of the February 3, 2024 re-election.

INEC announced that the PDP candidate polled 23,863 votes, defeating Agbo's candidate who polled 23,226 votes.

Agbo, who won the February 25, 2023 election but was removed from office by the Court of Appeal, went to court to challenge Atigwe's declaration.

The lawyers argued that the re-election was marred by miscalculation of results and serious non-compliance with election laws.

In a ruling on Wednesday, August 14, the court headed by Justice H.N. Kunaza declared that the petition had merit and that Dennis Nnamdi Agbo was the actual winner of Igbo-Eze North/Udenu Federal Constituency.

Justice Kunaza’s panel declared the 2,000 votes added to the PDP candidate null and void and restored the 14,229 votes of the PDP and the 28,870 votes of the LP candidate, Senator Dennis Agbo, on February 25, 2023.

It also held that since the petitioner won with 23,221 votes and the PDP with 21,863 votes, Atigwe was not duly elected by valid votes and, therefore, the demobilisation certificate issued to Atigwe should be cancelled and issued to Agbo.
