Appeal Court Dismisses Tonye Cole’s Petition Challenging Rivers State Governor and Sim Fubara’s Election

The Lagos State Court of Appeal today, November 28, dismissed the petition filed by the governorship candidate of the All Progressives Congress (APC) in Rivers State, Patrick Tonye-Cole, against Governor Siminalayi Fubara of the Peoples Democratic Party (PDP) and the Independent National Electoral Commission (INEC).
Tonye-Cole has approached the court to issue an order to INEC to declare him winner of the March 18 Rivers gubernatorial election. The Rivers State Governorship Election Petition Tribunal in October dismissed Tonye-Cole’s petition challenging Fubara’s election as governor of the state. The court found that the APC which sponsored Cole in the election withdrew its petition against Fubara’s victory.
Not satisfied with the court’s decision, the APC candidate appealed to the court of appeal. The appeals court this morning upheld the court’s verdict and affirmed Fubara as the duly elected governor of the state.
